We own a 1997 Double wide mobile home, we have been having some problems over the years with it…never knew why though. Til this year things have not been bad. But things got bad very bad, In mine and my parents bathroom their is alot of Black mold, The living room window unit which is huge 3 section window is falling out some, and We had talked to our finance and insurance company..(green Tree) They sent out a person who stated it was manufacturer default, Their were supposed to be Flashing in different places. The guy took pics, we were told we could get a copy and know we cant. Also found some papers it says we stop paying the finance we will be foreclosed on. But Are house is really not safe to live in No more, my dad has VA disability and can not work cause of his MS. so we dont have enough to pay on the finance and to pay for an apt. I really need some suggestions or to know if theirs a way legally to go about not paying are morgarge since are manufactured home is no longer a choice for us. Also trying to get a lawyer…not entirely sure though if this would be a liability suit or what. I live in NH and need all advice.

My finance and I own a home together. He grew pot plants in our house and I didn’t do it myself but I knew about it. We were busted and I ended up getting a possession charge while he got a manufacturing charge. It was a terrible situation. After all was said and done he ended up in jail because he broke the rules on his probation. Now he is out again and wants to grow illegal mushrooms. Based on this information you may think I am crazy to stay with this person but my head and heart say two different things. If I move out and he grows these anyway can I still get in trouble because I am on the mortgage? What can I do to convince him this is a bad idea? I don’t have the heart to turn him in myself. He is a good person but has some stupid ideas sometimes. I have tried to talk to him and I even got rid of everything when he started it but he still decided to start it again. I am also 8 months pregnant and I cannot stop thinking about the position this puts me and my child into if we were to get caught again.

My hubby and I will be getting a divorce (uncontested hopefully). We’ve been together for 11 yrs and married for 4 yrs. We do not have any kids. We agree on the division of most of property, and the only major asset we have is our 2001 manufactured home; therefore, this is the main dispute. We still owe K on the house; tax appraisals say it’s worth K. I feel that he should “get” the house. I have no prob. w/this b/c it sits on his family’s land. I think he should buy out my half of the equity (K), re-finance, and continue to pay the mortgage w/o my name on it. Therefore, he can do whatever he wants w/it – sell, keep, move elsewhere, etc. He thinks I should only get approximately K from the house – which is half of what it’s worth (K) minus half of what is still owed (my part of the debt – K). He also does not want to put more money into this house than he needs to.

A few questions:

1) Am I still responsible for this original debt? It would seem that if he would get the house, then I’m done w/the house. I think it would be the same as if I were a roommate that moved out but since it’s a house, there’s equity. But I think only getting K from this house is unreasonable considering what we’ve both put in to it. We’ve both paid an equal amt., literally – if he paid the month’s mortgage, then I would pay him half of the bill and vice versa. We’ve never combined our accts.; we’ve always kept them separate but made sure the bills got paid. This has worked for us.

2) So if this is the only dispute, would this still be considered an uncontested divorce or since we’re disputing the house and can’t come to an agreement, is it contested?

3) Should we seek legal representation? My hubby does not want a lawyer to get involved b/c of the cost. I would like legal advice just to make sure everything is equitable, fair, and done right. Is getting a lawyer a waste of money? I would not want this to become more antagonistic due to the involvement of a third party. Could a mediator help in this situation? What are the advantages/disadvantages of both (lawyer an mediator)?

4) Have any of you been in a situation like this – where you have no real assets and you can agree on the separation of most things? How did it turn out? How did you resolve any disagreements?

I am not sure how I will handle this situation regarding possible taxes (capital gains?) that I may have to pay, (or not). What happened is: my mother had a manufactured home she bought for cash (0k) about 3 years ago. About 2 years ago we transfered the home into my name (removing mother’s name from house) because we knew she’d have to go into a nursing home somewhere down the road. This past summer in Aug ‘08 she finally had to go into a nursing home (she has alzheimers which was slowly getting worse). Now I have the empty house in my name which I need to sell soon. I will only be able to get about k for it now with market drops this past year. My question: Once I sell the home and get the proceeds, will that be reported to the IRS and will I have to pay any kind of short term or long term capital gains, or any other type of taxes, on the sale of this property – considering the time frames are fairly short, for example its only been in my name for about a year. Thanks to any tax/finance experts who can help me with answer this question (or anyone who’s been in the same situation).

We bought a Manufactured Home in 2006, but the house is worth less the what the actual loan-amount is. The Mortgage Company does not re-finance, never been late and been paying more every month.
The house is build in 1997.

I have legal fees and credit cards i can no longer pay. I have a loan on my vehicle and my home (manufactured) is finance. Can I keep the vehicle and my home out of the bankruptcy?

My husband and I bought a manufactured home back in 2001. Unfortunately, we were very inexperienced and did not understand that having money down at closing was so important. At the time, we also had bad credit, but the dealer was determined to sign us. We ended up buying down 7 points and rolling it into the cost of the loan along with the other closing costs in order to lower our interest rate into something we could afford. It was lowered from 12.5% to 10.75%. We have always made timely payments for the last 6 years, but would like to refinance to get the incredibly high interest rate down. Our current lender says that 10.75% is their lowest rate, and our credit union won't finance due to the negative equity. The house is appraised at ,000 and we still owe ,000 on the loan. I've heard that there are loans available for 125% of a home's value, but not if it's manufactured. Does anyone know of any alternatives or have any useful suggestions to help us?
Also, just to clarify, the house is attached to a permanent foundation on a piece of land that my husband and I own.

I am financing a modular home in a trailer park. I am able to pay it off but then I will own it…… I know I owe like ,000.00 on it and it needs a lot of work! Practically everything inside and including the porches and siding need to be redone. With the amount of money it will take to pay off the finance and repair it I might as well buy a brand new home!! However, I do not know what to do to move. Do I just abandon it and wait for the courts to find me or is there actually a way for me to break free and get rid of it all together??? Someone please help!!! I need to get out!
I do not want to live in another modular or trailer. I am so sick of living in a trailer park as well. No privacy and a falling down home. I hate how many stray cats like to tear up my garbage and the skirting of my home.

I am looking at refinancing our manufactured home that is permanently attached (with concrete pillars) to our 6 acres of land. Right now, we currently owe more than the value of the property. I have tried several different lenders and have been told they won't finance for more than the value. Any suggestions?
